1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of breakheroes.com (the "Service"), operated by BreakHeroes ("we", "us", or "our"). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

The Service provides travel timing analysis: ranking calendar windows for destinations based on public-holiday calendars, school break schedules, seasonality patterns, and curated editorial content. The Service is provided free of charge for personal, non-commercial use.

3. Acceptable Use

You may:

  • Browse, link to, and share content from the Service.
  • Use Service output to inform your personal travel decisions.
  • Quote brief excerpts with proper attribution.

4. Prohibited Activities

You agree not to:

  • Scrape, crawl, or otherwise extract data from the Service at scale, including via automated means or scripts.
  • Republish, redistribute, or commercially exploit Service data without prior written permission.
  • Reverse engineer, decompile, disassemble, or attempt to derive source code.
  • Use the Service for any unlawful purpose or in violation of third-party rights.
  • Frame, mirror, or otherwise reproduce the Service's interface or branding.
  • Interfere with or disrupt the Service, including via denial-of-service attacks, malicious software, or attempts to overload servers.
  • Circumvent rate limits, security measures, or access controls.

5. Intellectual Property

The Service and its original content, features, branding, design, code, and curated editorial materials are owned by BreakHeroes and protected by copyright, trademark, and other intellectual property laws.

Underlying public-holiday and school-break data is sourced from government publications and reused under fair-use and public-information principles.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes only.

6. Third-Party Content and Links

The Service may contain links to third-party websites or display content from third-party sources. Such content remains the property of its respective owners. We do not control, endorse, or assume responsibility for third-party content. Your interactions with third parties are governed by their own terms and privacy policies.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service's recommendations, ratings, or data are accurate, complete, current, or reliable.
  • The Service will be uninterrupted, secure, error-free, or free of malicious software.
  • Predictions about prices, weather, crowd levels, or events will materialize.

Recommendations are directional indications based on historical patterns. Use the Service alongside live booking data and your own judgment.

8. Limitation of Liability

To the maximum extent permitted by applicable law, BreakHeroes, its operators, contributors, and affiliates shall not be liable for any:

  • Indirect, incidental, special, consequential, exemplary, or punitive damages;
  • Loss of profits, revenue, data, opportunity, or goodwill;
  • Travel disruptions, missed bookings, financial losses, or other harm arising from reliance on Service output;
  • Damages arising from third-party content or links;

regardless of the legal theory (contract, tort, statute, or otherwise) and regardless of whether we have been advised of the possibility of such damages.

Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, government actions, internet outages, or third-party service interruptions.

9. Indemnification

You agree to indemnify, defend, and hold harmless BreakHeroes and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of:

  • Your use or misuse of the Service;
  • Your violation of these Terms;
  • Your violation of any third-party rights;
  • Your violation of applicable laws.

10. Termination

We may suspend or terminate your access to the Service at any time, without prior notice, for any reason, including but not limited to breach of these Terms. Upon termination, your right to use the Service ceases immediately.

11. Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without notice. We may also update these Terms; the "Last updated" date reflects the most recent change. Continued use of the Service after a change constitutes acceptance of the revised Terms.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Croatia, without regard to its conflict-of-law provisions. Any dispute arising from or related to these Terms or your use of the Service shall be resolved exclusively in the competent courts of the Republic of Croatia.

13. Severability

If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

14. Language

These Terms may be translated into other languages for convenience. In case of any inconsistency between translations, the English version shall prevail.
